Driving Under the Influence


D.U.I.
California Vehicle Code 23152 defines the prohibitions for driving under the influence. It reads as follows:

(a) It is unlawful for any person who is under the influence of any alcoholic beverage or drug, or under the combined influence of any alcoholic beverage and drug, to drive a vehicle.

(b) It is unlawful for any person who has 0.08 percent or more, by weight, of alcohol in his or her blood to drive a vehicle.

The state charges you with both sections (a) and (b) which makes it eaier to obtain a conviction.

If you are charged with a DUI. There are defenses and you may actually be innocent of the charges. The legal limited in California is .08. this can be as little as 1 or 2 drinks depending on your weight and body size. 

A common reduction to a traditional driving under the influence charge is wet reckless. This is a reduced charge  of reckless driving with alcohol related.
