Negligent OperatorNegligent Operator A California driver may face a negligent operator suspension from the California Department of Motor Vehicles (DMV) for a number of reasons. These include an injury accident where the driver is found to be at fault, and cases where a driver is found to be physically impaired or using medications that may impair their ability to drive a motor vehicle in a safe manner. In these situations, the California Department of Motor Vehicles (DMV) can and will suspend a person’s privilege to drive for an extended period of time. A driver has the right to have a hearing to contest such a suspension. Our law firm routinely contests these hearings on behalf of drivers, and/or fights to have driving privileges reinstated by proving that the allegations are false or exaggerated, or that the situation at issue has been sufficiently remedied. Medical Conditions The Department of Motor Vehicles (DMV) can suspend a person’s privilege to drive where it finds that a medical condition or medication impairs the ability of that person to drive a motor vehicle safely. This usually occurs with such medical conditions as epilepsy and other seizures that impair a person’s motor functions in dramatic and sudden episodes. Impairment can also occur with the use of medications to combat such seizures, since that medication can dull a person’s thought processes and motor functions.
